I. TERMS USED IN THESE TERMS

1.3. The final price of the goods is written on the presentation page of the respective product in Bulgarian levs. All prices shown on this site include VAT and do not include delivery charges. The delivery prices are indicated separately and represent the delivery amount of the specific courier company with which we have a cash on delivery contract.

1.4. When using the provided means of communication with us, there is no additional value charged.

2. The contents of the sugabuba.com e-shop use the registered signs and brands, photos from the catalogs, texts, etc. of different companies and the rights to these materials belong to the respective company. All other materials from the content of the site (including but not limited to photos, graphics, text, illustrations and design) are the property of Shuga Company Ltd. Their use for commercial, advertising or other public purposes, use through public distribution, copying, publication on other websites in the global network, the creation of derivative materials from the content of the electronic store, changes to the content, transmission, display, reproduction of the content, the creation of secondary materials are violations of copyright and related rights and are prosecuted by law. When purchasing without registration, acceptance of these Terms is required for each order, as well as familiarization with the information in their part on personal data protection.

1.3 Order made by telephone. The order information contains a listing of the products ordered, the customer's name, contact telephone number and delivery address. For phone orders, the only possible method of payment for the goods is cash on delivery. It is assumed that when placing an order by phone, the Customer has previously familiarized himself with the present General Terms and Conditions, including the part concerning the protection of personal data. If necessary, the opportunity to become familiar with these General Terms and Conditions, including their part regarding the protection of personal data, is indicated and explained to the Customer when placing the order over the phone.

IV. RIGHTS AND OBLIGATIONS OF THE PARTIES

1. The successfully registered user, as well as the one who makes an order by phone or an order through the sugabuba.com e-shop site, is given the right to order the offered products and services or to refuse or advertise them in due order.

2.3. Delivery of the requested product/s or service, to be carried out at the delivery address specified in the request, after payment of the sales price according to the order described in these "General Terms and Conditions".

3. The user is obliged to:

3.2. Not to violate the rights and freedoms of citizens, according to all laws and regulations in the country and in European rules, including by not providing personal data to data subjects other than himself.

3.3. To observe internet ethics and rules when using the products and services provided by Shuga Company Ltd.

3.4. Not to violate other's property or non-property, absolute or relative rights and interests such as property right, intellectual property right, right to protection of personal data, etc.

3.5. To immediately notify "Shuga Company" OOD and the relevant authorities of any case of committed or detected violation when using the provided services.

3.6. Not to commit malicious acts.

4. The online store sugabuba.com has the right:

4.1. Deny access and cancel user registrations.

4.2. To refuse orders at no cost to the user. In this case, sugabuba.com does not owe compensation in any way to the user, except to refund the amounts paid by the user in advance, when there are technical errors made in the publication of information.

4.3. To edit the content of the website - such as existing prices, terms of use, products, services, information, photos, etc. at its sole discretion and at any time without notice. The new terms and conditions come into effect at the moment of their publication.

4.4. To use at its sole discretion all comments, suggestions, ideas, etc., sent or suggested by users of the electronic store sugabuba.com. They remain the property of "Shuga Company" OOD and in this sense the company is not limited in their use and is not obliged to pay any compensation to the users for their comments, ideas and suggestions.

4.5. To preserve materials and information used/located on the server on which sugabuba.com is located or made available to third parties by a user, and to provide them to third parties and relevant government authorities in cases where this is necessary to preserve the rights and the legal interests, property and security of "Shuga Company" OOD, as well as of third parties, in the cases of claims brought in connection with the violation of their rights on the occasion of information or materials used or distributed, taking into account the applicable rules regarding the protection of privacy data, as well as in cases where the materials or information are requested by state authorities pursuant to an express legal provision;

4.6. To terminate, stop or change the provided services at any time without notifying the user, when the latter uses the services in violation of these "General Terms and Conditions".

5. The sugabuba.com e-shop:

5.1. It does not have the obligation and the objective possibility and does not control the way users use the services provided.

5.2. It does not guarantee the accuracy and completeness of the published product information.

5.3. Together with its suppliers or third parties shall not be liable under any circumstances for any damages of any kind, including but not limited to damages for lost profits, loss of information or otherwise, arising out of the use, inability to use or results from the use of sugabuba.com e-shop. If damages occur as a result of your use of the sugabuba.com e-shop, products or services from it, you assume all responsibility and all costs related to the removal of the damages.

5.4. It is not responsible for possible differences in the colors of the purchased products due to the specifics of computer screens. Applying for the purchase of specific products is considered an express consent by the user regarding their type and quality.

5.5. It is not liable to users and third parties for damages suffered and lost benefits resulting from the termination, suspension, modification or restriction of services, deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information transmitted, used, recorded or made available through the sugabuba.com e-store

5.6. It is not responsible for damages caused to software, hardware or telecommunications equipment or for loss of data resulting from materials or resources searched for, downloaded or used in any way through the services provided.

6. The advice, consultations or assistance provided by the specialists and employees of the electronic store sugabuba.com in connection with the use of the services by users do not give rise to any responsibility or obligations for "Suga Company" Ltd.

1. GOODS

1. The goods sold are the property of "Shuga Company" OOD.
2. The customer sees on the sugabuba.com site only the products that are currently available. If it happens that a customer places an order for a product that is not available, he is immediately notified by phone

1. PRICES AND TERMS OF DELIVERY

1. The delivery of products with a total value of over BGN 100 may be at the expense of sugabuba.com, when such a promotion is announced on the website on a/ product pages, b/ the home page or c/ on the order payment page when selecting a method of delivery.
2. The price for standard delivery in Bulgaria is BGN 7. Deliveries to the office of the courier company Speedy are free.
3. Deliveries are made only on the territory of Bulgaria and only after confirmation by the user. For deliveries outside Bulgaria, other prices apply, depending on the country of the user. Sugabuba.com reserves the right to change shipping rates at any time, with the current shipping rates being the current rates on the sugabuba.com website.

Confirmations: A representative of the sugabuba.com electronic store contacts the user by phone to confirm the order and specify the day and time of delivery during business hours.

5. Delivery to an address is carried out by courier from Monday to Friday between 9.00 and 17.00, (Saturday until 14.00). Deliveries are not made on Sundays and public holidays.
6. The delivery time is from 1 (one) to 3 (three) working days from the date of dispatch of the delivery. Shuga Company Ltd. is not responsible for a delayed shipment caused by the courier company.
7. Orders placed after 4pm on weekdays are processed the next business day. All Saturday and Sunday requests are processed on Monday.
8. The user is obliged to check whether the contents of the shipment correspond to his order before paying the price. By paying the price of the order and delivery and placing the signature of the user on the delivery documents, the latter gives his consent to the type and content of the delivery.
9. The order is received only by the person who placed the order
10. If the goods are not delivered for various reasons during courier delivery, the latter is obliged to visit the site a second time within the working day or the next working day. The second visit is carried out after contact has been established by telephone between the courier and the person who guarantor of the goods. The return visit is not paid for by the customer.
11. In case of advance payment, and the customer's refusal to receive the order within 7 days, the value of the products will be refunded in the manner specified by the customer, and the payment costs will be borne by the customer.
12. Due to non-observance of the day and time of delivery set by the user, or in the event that the customer refuses to receive his shipment, and the payment was made in advance, "Shuga Company" Ltd. undertakes to refund the value of the products, less the paid delivery fee.
13. The customer has the right to refuse an order within the statutory 14-day period.
14. In the case of a wrong or missing product, the one desired by the customer is sent on the same or the next working day. A wrong product is replaced at the expense of "Shuga Company" OOD. In the case of a wrong or missing product, the customer does not pay an additional delivery fee.
15. With certain promotions, the customer can receive the right to free delivery for orders worth less than BGN 50.
16. You can return a purchased product within 14 days from the date of purchase with an attached receipt. The return condition is that the product is unused, in intact packaging and with the manufacturer's and importer's labels. Transport costs are at the customer's expense. Money is refunded within 3 days from the date of receipt of the product back to us.

8. Grounds and Purposes of Personal Data Processing

 

"Suga Company" Ltd. processes (collects, stores and uses) personal data for the Clients based on any of the below-mentioned grounds and with a view to achieving any of the below-mentioned goals:

 

1. Fulfillment of legal obligations of "Shuga Company" Ltd

 

"Shuga Company" Ltd. processes personal data for Customers in order to fulfill legal obligations related to the services provided, including, but not limited to:

 

• carrying out online trade; and

 

• a response to an official inquiry by a duly authorized public or judicial authority.

 

1. Performance of a contract entered into with or for the benefit of Customers, or to take steps at the request of natural persons, data subjects, prior to the conclusion of a contract

 

"Shuga Company" Ltd. processes personal data for the conclusion and execution of contracts for online ordering and sale of the products offered by the Company, as well as for the fulfillment of rights and obligations according to these General Terms and Conditions, as well as to provide information regarding the services, in which potential Customers have indicated an interest (e.g. receiving email or telephone confirmation of a successful order), as follows:

 

• establishing relations with new Clients;
• conclusion, amendment, execution and termination of contracts;
• communicating with Customers.

 

1. Purposes related to the legitimate interests of Shuga Company Ltd. as follows:

 

• internal accountability;
• collection of receivables; and
• verification activities when returning purchased products or canceling an order.

 

If it becomes necessary for "Shuga Company" Ltd. to carry out additional processing for purposes other than those specified above in this part of the General Terms and Conditions, "Shuga Company" Ltd. will inform the Clients when it is necessary to obtain their consent for this.

 

Due to the nature of the above outlined type and volume of personal data collected when using the website of "Shuga Company" Ltd., in case of failure to provide some or all of them, "Shuga Company" Ltd. may be unable to provide the requested order or service.

9. Categories of recipients of personal data

In order to fulfill the aforementioned goals, "Shuga Company" Ltd. may disclose personal data of the Clients to the following categories of recipients:

• service providers who perform services on behalf of "Shuga Company" OOD at or for the purpose of using the "Shuga Company" OOD website;

• business partners at or for the purpose of using the website of "Shuga Company" OOD to carry out orders (courier companies, postal operator, etc.);
• public or judicial authorities, upon request, to the extent permitted by law;

10. Transfer of personal data outside the European Economic Area (EEA)

"Suga Company" Ltd. can carry out international transmission of data originating from the EEA, when the European Commission has recognized a country outside the EEA as providing an adequate level of data protection.

 

For transmissions to countries outside the EEA, the level of protection of which is not recognized by the European Commission, "Shuga Company" OOD will refer either to a certain derogation applicable to the specific situation, according to the Regulation, or will apply one of the guarantees provided by the applicable legislation .

 

In other cases, for the transmission of personal data outside the EEA, this is carried out based on the express consent of the Clients for the proposed data transmission, obtained in compliance with the requirements of the Regulation for this.

 

11. Periods of storage of personal data

 

"Shuga Company" Ltd. retains personal data for the Clients for the longer of the periods necessary either to comply with the applicable laws and by-laws, or another period according to the requirements applicable to the activities of "Shuga Company" Ltd. The processing of personal data is based on the principle of reducing the data to a minimum, depending on and for the purposes of the orders placed by the Customers. Part of the data may be stored after completion of the order requested by the Customer for the purposes of fulfilling legal obligations of "Shuga Company" OOD or for the purposes of the legitimate interests of the company.

 

12. Rights of subjects in relation to personal data protection

 

In accordance with the applicable regulatory requirements, the Client has the right to:

 

• information, when collecting personal data from him or from third parties;

 

• right of access to his personal data and in particular: (i). confirmation whether personal data about him are processed by "Shuga Company" OOD; (ii). providing access to the data through a copy of the data that is being processed, as well as information about the purposes of the processing; the categories of personal data; the recipients or categories of recipients to whom the personal data has been or will be disclosed; the terms of storage of personal data; the existence of the right to correct or delete personal data or to limit the processing of personal data, or to object to processing; the right to appeal to the Supervisory Authority (which in the Republic of Bulgaria is the CPLD); the sources of personal data; the existence of automated decision-making, including profiling.

 

• right to correction – to request the correction or completion of his personal data if the same are inaccurate or incomplete;

 

• right to delete personal data when the grounds provided for in the applicable legislation are present;

 

• right to restriction of processing;

 

• right to data portability;

 

• right to object;

 

• his right not to be subject to a decision based solely on automated processing, including profiling, which gives rise to legal consequences or otherwise significantly affects him;

 

• giving, changing or withdrawing consent for the processing of personal data, when the basis for the processing is his consent.

 

Customers can exercise their rights by submitting a written application to "Shuga Company" OOD, in one of the following ways:

 

• by e-mail to the above-mentioned e-mail address of the Company through a qualified electronic signature, according to the Law on electronic document and electronic authentication services;

 

• by mail to the Company's customer contact address with the sending of a notarized application in order to ensure identification of the applicant. In cases where the application is submitted by a legal representative of the applicant, or through a representative of the applicant authorized with a notarized power of attorney, the application should also contain a notarized signature of the person signing on behalf of the applicant.

 

13. Changes to the privacy policy

 

"Shuga Company" Ltd. informs the Clients about any significant changes to these General Terms and Conditions, including the part concerning the protection of personal data, through its website or through other usual communication channels.
